
Parliamentary Commissioner for the Federal Police Authorities
The German Parliamentary Commissioner for the Federal Police Authorities is an auxiliary organ of the German Parliament.
It is based on a new legislation adopted on 28th February 2024 and election of the Commissioner on 14th March 2024 : https://www.gesetze-im-internet.de/polbeauftrg/BJNR0480A0024.html (deutsche Sprache). By law, the post of Commissioner is an independent office outside of the police authorities structures. The Commissioner is not bound by instructions in his work.
The Commissioner of the Federal Police Authorities is responsible for the German Federal Police Authorities, which include the Federal Police, the Federal Criminal Police Office and the Police of the German Bundestag. The Commissioner‘s core tasks include identifying and investigating potential structural deficiencies or undesirable developments within the Federal Police Authorities and evaluating and investigating specific cases of potential misconduct of the Federal Police Authorities. In light of their important role, the police have a significant influence on the public’s relationship with the state.
The Commissioner of the Federal Police Authorities takes action in response to submissions received from the public and from employees of the Federal Police Authorities. Furthermore, the Commissioner has the discretion to act on his own initiative upon becoming aware of relevant circumstances concerning structural developments within the Federal Police Authorities.
The Commissioner is equipped with a range of statutory powers in order to perform his tasks efficiently and effectively:
The Parliamentary Commissioner for the Federal Police Autorities may question or obtain written information from the employees of the Federal Police Authorities. The Parliamentary Commissioner for the Federal Police Authorities may request comment from the Federal Police Autorities. The Commissioner may add his own assessment to this comment and forward it to the affected body. The Parliamentary Commissioner for the Federal Police Autorities may request that the Federal Police Autorities release files or other officially kept documents, in the original where necessary, and transfer data stored in digital files. The Parliamentary Commissioner for the Federal Police Autorities may access the offices and premises of the Federal Police Authorities at any time without prior notice.
